Trademark Registration 2026: Complete Process Step By Step

Trademark Registration 2026 – Overview

Trademark registration is the most effective way to legally protect your brand name, logo, tagline or product label in India. A registered trademark gives you exclusive rights to use the mark and restricts others from copying or misusing your brand identity.

In 2026, the process of trademark registration in India is completely online through the IP India portal. Once your mark is registered, you can use the ® symbol and build long-term value for your business, startup or NGO.

Quick Note: Even before final registration, a properly filed application allows you to use the symbol and claim priority rights over the brand.

Benefits of Trademark Registration

  • Exclusive brand rights: You get the legal right to use the mark for specific goods or services across India.
  • Brand protection: Helps you take action against misuse, counterfeits or look-alike brands.
  • Business credibility: Registered marks build trust with customers, investors and partners.
  • Asset creation: A trademark is an intangible asset that can be licensed, franchised or even sold.
  • Global expansion support: Indian registration is helpful while applying for international protection under Madrid Protocol.

Eligibility for Trademark Registration

Any person or entity using or planning to use a distinctive mark in business can apply for trademark registration in India.

Applicant Type Who Can Apply
Individual / Proprietor Any person using a brand name, logo or label for goods or services.
Partnership / LLP / Company Registered business entities using a tradename, logo or product branding.
NGO / Trust / Society Non-profit organisations protecting their project name, logo or campaign brand.
Startups / MSME Recognised startup or MSME units can also apply and may be eligible for concessional fees as per rules.

Types of Trademarks & Classes in India

Trademarks are registered in 45 different classes based on nature of goods and services. You can register one or multiple classes depending on your business activities.

Trademark Type Examples What It Protects
Word Mark Brand name like “AVINEXT”, “FASTCARE” Protects the name in plain text regardless of style or font.
Logo / Device Mark Stylised logo or symbol Protects graphic representation, design and style.
Tagline / Slogan “Your Brand, Our Strategy” Protects marketing slogans associated with your brand.
Combination Mark Logo + Brand Name together Protects both text and visual elements in combined form.
Series / Label Mark Product labels, packaging designs etc. Protects overall label layout, colour, style and device.
Tip: For stronger protection, many businesses register both a word mark and a logo mark in the relevant classes.

Documents Required for Trademark Registration

  • Applicant KYC: PAN, Aadhaar or registration certificate of company / LLP / firm.
  • Brand Logo (optional): High-quality image of logo (preferably 1000 × 1000 pixels) if logo/device mark is to be filed.
  • Proof of Business: GST certificate, MSME registration, incorporation certificate etc. (as applicable).
  • Power of Attorney (Form TM-48): Authorisation in favour of your trademark agent or attorney.
  • Usage Proof (if applicable): Invoices, brochures or website screenshots showing prior use of mark.
  • Mail & Mobile: Active email ID and phone number for all official communication.

Trademark Registration Process 2026 – Step by Step

  1. Identify the Brand Elements: Finalise your brand name, logo, slogan and decide how you want to protect them.
  2. Trademark Search: Conduct a detailed search on the IP India database to check for similar existing marks.
  3. Select Correct Classes: Map your products or services with the appropriate trademark class or multiple classes.
  4. Prepare Documents: Collect KYC, business proof, logo files and execute Power of Attorney (TM-48) if filing through an agent.
  5. File Online Application (TM-A): Submit the application on the IP India portal with all details and pay the prescribed fee.
  6. Examination by Registry: The trademark office examines your application and may issue an examination report raising objections or seeking clarifications.
  7. Reply & Hearing (if required): File a detailed reply to objections and attend hearings, if scheduled, to argue your case.
  8. Publication in Journal: Once accepted, the mark is published in the Trademark Journal for a 4-month opposition period.
  9. Opposition (if any): If someone opposes your mark, the matter is decided through a quasi-judicial process of pleadings and hearing.
  10. Registration & Certificate: In the absence of successful opposition, the mark proceeds to registration and you receive the certificate, allowing you to use the ® symbol.
Important: A registered trademark is valid for 10 years from the date of filing and can be renewed indefinitely every 10 years by paying renewal fees.

Trademark Registration Govt. Fees & Professional Charges

The cost of filing a trademark depends on the type of applicant and number of classes selected. Government fees are charged per class and per application.

Applicant Category Govt. Filing Fee (Per Class – Approx.)
Individual / Startup / MSME Relatively lower fee as notified by the Trademark Rules (concessional category).
Company / LLP / Other Entities Higher standard fee per class compared to individual or MSME applicants.
Professional / Legal Charges Varies based on complexity, number of classes and response to objections or hearings.
